ORDINANCE NO. 10-09

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF OKALOOSA COUNTY FLORIDA; PROVIDING FOR A SHORT TITLE; PROVIDING FOR THE REPEAL OF ORDINANCE 04-79; PROVIDING FOR THE CREATION OF A NEW SECTION 6-134 OF ARTICLE VI OF CHAPTER 6 OF THE CODE OF ORDINANCES OF OKALOOSA COUNTY, FLORIDA; PROVIDING FOR THE REPEAL OF ALL OTHER CONFLICTING PROVISIONS; PROVIDING FOR INCORPORATION INTO THE CODE OF ORDINANCES OF OKALOOSA COUNTY, FLORIDA; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

ORDINANCE OF 2010

SECTION 1. SHORT TITLE.

This Ordinance shall be known and may be cited as the “Okaloosa County Florida Permitting and Inspection Fee Ordinance of 2010”.

SECTION 2. REPEAL OF OKALOOSA COUNTY ORDINANCE 04-79.

Ordinance 04-79, the Okaloosa County Permit Fee Ordinance, is hereby repealed in its entirety including all its attachments.

SECTION 3. CREATION OF SECTION 6-134 OF ARTICLE VI OF CHAPTER 6 OF THE CODE OF ORDINANCES OF OKALOOSA COUNTY, FLORIDA.

A new section 6-134 of Article VI of Chapter 6 is hereby created and shall be added to the Code of Ordinances of Okaloosa County, Florida, as follows:

Section 6-134 Building Permits and Fees

A. Definitions. Except as provided herein, the terms and phrases used in this Section shall have that definition assigned in the 2007 Florida Building Code. Terms and phrases not defined in the Florida Building Code shall be ascribed that meaning they have in common usage which most clearly implements the intent of this Section.

B . A permit is required when:

(1.) An owner, authorized agent or contractor desires to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure. As used herein, the term building means a roofed and/or walled structure enclosing a space used for sheltering any occupancy. As used herein, a structure is anything constructed or erected with fixed location on the ground, measuring thirty (30) inches above natural grade. A structure may be a building, deck, sign, billboard, liquid storage tank, antenna or tower.

(2.) An owner, authorized agent or contractor desires to erect, enlarge, alter, repair, remove, convert, or replace any electrical, gas, mechanical, or plumbing system, the installation of which is regulated by the technical codes.

(3.) Each underground utility system will require plans, permitting and inspection by the Okaloosa County Department of Growth Management, Okaloosa County Water and Sewer Department and Okaloosa County Public Works Department.

C. Permit, Plan Review, Inspection, and Miscellaneous Fees:

(1.) Total Fee Amount: The total fee shall be determined by adding the amounts calculated for the building permit fee (Section 2, below) plus all applicable sub-permit and other fees as provided in sections (2) through (17), below, unless otherwise specified in this ordinance. A base fee of $60.00 shall be required for all building permits and each sub permit.

(2.) Building Permit Fee:

(a.) The building permit fee for all new buildings shall be calculated using Table 1, below. The valuation shall be determined by application of the February 2010 Square Foot Construction Cost table promulgated by the International Code Council attached hereto as provided in Table 2, below. Multiple Use facilities shall be based on the primary use of the facility and shall be calculated as provided in Section (3) unless otherwise specified in this Section.

(b.) The building permit fee for projects other than new buildings and structures (for example remodeling, renovations, reroofs, pools, docks, decks, siding, change out of windows and or doors, boathouses, detached garages, etc.) shall also be calculated using Table 1., above; however, the valuation shall be the cost of construction. The Building Official reserves the right to request copies of contracts, invoices/estimates, and/or other materials as may be required.

(d.) Mechanical Permit Fees:

The fee for inspections for all new heating, ventilating, air conditioning and refrigeration systems and repairs to existing systems shall be $35.00 for the first $4,000, or fraction thereof, of valuation of the installation plus $5.00 for each additional $1,000 or fraction thereof.

(e.) Fire Sprinkler System Permit: $1.00 per head.

(5.) Moving of Building or Structure: For the moving of any building or structure a fee of $75.00 will be assessed plus a base fee. Any electrical, plumbing, or mechanical work done in conjunction with moving a building or structure will be subject to the appropriate sub-permit and base fees, as applicable.

(6.) Irrigation and Lawn Sprinkler Permit: $15.00 plus a base fee.

(7.) Mobile Home Setup: For the placement or replacement of any mobile home for other than storage use, the fee shall be $35.00 plus a base fee. Any electrical, plumbing, or mechanical work done in conjunction with setting up a mobile home will be subject to the appropriate sub-permit and base fees, as applicable. As used in this part, a mobile home is a structure, transportable in one or more sections, which is 8 body feet or more in width and which is built on an integral chassis and designed to be used as a dwelling when connected to the required utilities and includes the plumbing, heating, air-conditioning, and electrical systems contained therein. As used herein, the term mobile home can also mean "manufactured home" when denoting a mobile home fabricated on or after June 15, 1976, in an offsite manufacturing facility for installation or assembly at the building site, with each section bearing a seal certifying that it is built in compliance with the federal Manufactured Home Construction and Safety Standard Act . As used in this part to establish the mobile home set up fee, neither the term “mobile home” nor “manufactured home” shall apply to any structure, building assembly, or system of subassemblies, which may include structural, electrical, plumbing, heating, ventilating, or other service systems manufactured in manufacturing facilities for installation or erection as a finished building or as part of a finished building, which shall include, but not be limited to, residential, commercial, institutional, storage, and industrial structures and built to comply with the Florida Building Code. Structures built to comply with the Florida Building Code, e.g., “a DCA manufactured building”, are subject to the applicable building permit, sub-permit, and base fees.

(8.) Demolition of Building or Structure: For the demolition of any building or removal (without replacement) of pollutant storage tanks, a fee shall be assessed as follows:

0 to 5,000 square feet $50.00 plus a base fee

5,001 square feet and up $100.00 plus a base fee

Removal of Pollutant Storage Tanks $25.00 plus a base fee

(9.) Commercial Plan Review and Resubmittal/Addendum Fees: A plans examination fee of $25 or 25% of the total permit cost, whichever is greater, shall be collected at the time of application for all commercial permits subsequent to October 1, 2010. The plan review fee shall be deducted from the amount owing at the time of permit issuance. Re-submittals and addendums will be assessed a fee of $60.00. A re-submittal is when plans have been rejected and are being submitted for continued review. An addendum is when changes are presented for an existing permitted project.

(10.) Residential re-submittals and addendums will be assessed a fee of $30.00. A re-submittal is when plans have been rejected and are being submitted for continued review. An addendum is when changes are presented for an existing permitted project.

(11.) Plan Review by the International Code Council. Any construction plans or documents deemed necessary for review by the International Code Council (ICC) shall be assessed a fee of $200.00. The electrical review of these plans or documents shall be 25% of the ICC Plan Review Fee.

(12.) Reinspection Fee: $ 35.00 per trip per trade.

(13.) Early Power Inspections:

(a.) Residential $50.00 each

(b.) Commercial $75.00 each

Note: The $60.00 base fee will not be charged for early power inspections.

(14.) Fax Fee Charge: $10.00 per permit

(15.) Special Request for Evening or Weekend Inspections . $100.00 per hour (a minimum of one (1) hour will be charged).

(16.) Street addresses. $15.00 per lot/unit.

(17.) Updating Permits: Another permit will be issued for the update and fees will be assessed for the new permit, as well as a base fee.

(18.) List of Contractor Names. A fee of $30.00 + .03¢ per name shall be collected for all requests for lists of contractor names.

(D.) Work Commencing Prior To Permit Issuance. Any person commencing any work on a building, structure, electrical, gas, mechanical, plumbing or underground utility system before obtaining the necessary permit(s) shall be subject to a penalty of 100% of the usual permit fee in addition to the required permit fees.

(E.) Building Permit Valuation. If, in the opinion of the Building Official, the value of a building, alteration, or structure appears to be underestimated on a permit application, the permit may be denied or recalculated, unless the applicant can show detailed cost estimates which meet the approval of the Building Official.

(F.) Compliance With all Applicable Codes and Ordinances. In all construction matters, the permit holder and owner are responsible for compliance with all the codes and ordinances adopted by Okaloosa County.

(G.) Surcharges and Other Fees. In addition to the fees provided above, Okaloosa County applies state surcharges (e.g., the radon fee pursuant to Section 468.631, and 553.721, Florida Statutes) and other non-County fees (e.g., credit card service charges) as required by law or contract.

Section 4. Incorporation into County Code. It is hereby directed by the Board of County Commissioners that Section 6-134 as provided in Section 3 incorporated into the Code of Ordinances of Okaloosa County, Florida, and that any renumbering of the various sections is hereby authorized as necessary to achieve that directive.

Section 5. General Repeal of Conflicting Provisions. Any ordinances or portions of the Code of Ordinances of Okaloosa County in conflict herewith are hereby repealed.

Section 6. Severability. If any section, subsection, clause, or other part of this ordinance is deemed unlawful in any court of law competent to decide such matters, said section, subsection, clause, or other part shall be severed and held as a separate provision and shall have no effect on the remainder.

Section 7. Effective Date. This ordinance shall take effect on October 1, 2010.
